Termos e Condições da Consulta Jurídica
Os presentes Termos e Condições regulam a marcação e realização de consultas jurídicas prestadas pela MAPV Advogados.
A MAPV Advogados é a designação utilizada pelo escritório de advocacia da Dra. Maria Alexandra Celorico Moreira Pacheco Vieira, Advogada, NIF 186 645 180, com domicílio profissional na Avenida Infante D. Henrique, n.º 43, R/C, 9500-150 Ponta Delgada, endereço de correio eletrónico alexpvieira-42a@adv.oa.pt e telefone +351 296 307 19.
A consulta jurídica constitui um momento inicial de análise de uma questão ou situação jurídica concreta.
Durante a consulta, serão analisados os principais elementos apresentados pelo cliente, esclarecidas as questões jurídicas relevantes e identificados, sempre que possível, os possíveis caminhos, procedimentos ou diligências a adotar.
A consulta poderá realizar-se presencialmente no escritório da MAPV Advogados, em Ponta Delgada, ou à distância, por videoconferência.
A consulta tem a duração máxima de 60 minutos e o valor fixo de 140,00 €, independentemente da duração efetiva da reunião dentro desse período.
O valor corresponde à consulta e à análise da questão apresentada nos termos previstos nestes Termos e Condições.
Caso a questão exija trabalho adicional, este não se considera incluído no valor da consulta e ficará sujeito a definição autónoma do respetivo âmbito e honorários.
O valor da consulta inclui:
A consulta destina-se à análise de uma questão jurídica concreta. Caso o cliente pretenda abordar matérias distintas ou autónomas, poderá ser necessária a realização de consulta adicional.
Sempre que existam documentos relevantes para a questão a analisar, estes deverão, sempre que possível, ser enviados antes da consulta.
A análise incluída no valor da consulta limita-se à documentação essencial e de extensão razoável para preparação e realização da reunião.
Quando a documentação seja particularmente extensa, complexa ou exija uma análise jurídica aprofundada, a MAPV Advogados poderá informar previamente o cliente da necessidade de trabalho adicional, sujeito a orçamento ou acordo de honorários autónomo.
O cliente é responsável por assegurar que os documentos e informações fornecidos são completos e exatos na medida necessária à apreciação da situação.
Salvo acordo expresso em contrário, a consulta não inclui:
Qualquer serviço adicional será objeto de acordo separado quanto ao respetivo âmbito e honorários.
O preenchimento do formulário disponibilizado no website constitui apenas um pedido de marcação e não determina a confirmação automática da consulta.
Após a receção do pedido, a MAPV Advogados procederá à respetiva análise e, quando necessário, à verificação da inexistência de conflitos de interesses e do cumprimento das demais obrigações profissionais aplicáveis.
A marcação apenas se considera aceite após confirmação expressa da MAPV Advogados, com indicação da data, hora e modalidade da consulta.
A MAPV Advogados poderá solicitar informações adicionais antes da confirmação da consulta quando estas sejam necessárias à identificação do assunto ou à verificação de impedimentos profissionais.
O pagamento da consulta poderá ser efetuado por:
A MAPV Advogados não dispõe de terminal de pagamento automático (Multibanco).
Após a confirmação da marcação, serão transmitidas ao cliente as instruções necessárias para pagamento.
Quando seja solicitado pagamento antecipado, a consulta considera-se definitivamente reservada após a receção ou confirmação do respetivo pagamento, salvo indicação expressa em contrário.
Caso o cliente não possa comparecer na data agendada, deverá comunicar essa circunstância com a maior antecedência possível.
O reagendamento ficará sujeito à disponibilidade do escritório.
A MAPV Advogados poderá igualmente propor o reagendamento da consulta quando ocorram circunstâncias profissionais, pessoais ou de força maior que impeçam a sua realização na data inicialmente prevista.
O cliente poderá cancelar a consulta mediante comunicação à MAPV Advogados.
Quando o cancelamento seja comunicado com menos de 24 horas de antecedência ou o cliente não compareça sem aviso prévio, a MAPV Advogados reserva-se o direito de considerar devido o valor da consulta, atendendo ao período profissional reservado para o efeito
Esta regra não prejudica situações excecionais devidamente justificadas nem os direitos que legalmente assistam ao cliente enquanto consumidor.
Em caso de atraso do cliente, a consulta terminará, em princípio, à hora inicialmente prevista, de forma a não prejudicar as marcações subsequentes.
Sempre que possível e mediante disponibilidade, poderá ser acordado um ajustamento.
Caso o atraso seja imputável à MAPV Advogados, será assegurado ao cliente o período de consulta contratado ou acordado outro horário adequado.
A realização da consulta não implica a obrigação de o cliente contratar serviços jurídicos adicionais nem a obrigação da MAPV Advogados de aceitar qualquer mandato posterior.
Caso, na sequência da consulta, seja necessário acompanhamento jurídico adicional, será definido separadamente o âmbito dos serviços a prestar e os respetivos honorários.
Quando a consulta seja contratada à distância por uma pessoa singular que atue para fins que não se integrem no âmbito da sua atividade comercial, industrial, artesanal ou profissional, poderá ser aplicável o regime legal de proteção dos consumidores relativo aos contratos celebrados à distância.
Nesses casos, o consumidor dispõe, em regra, de 14 dias a contar da celebração do contrato para exercer o direito de livre resolução, sem necessidade de indicar qualquer motivo, nos termos do Decreto-Lei n.º 24/2014, de 14 de fevereiro.
Caso a consulta seja realizada antes do termo do prazo de 14 dias, serão aplicáveis as regras legalmente previstas para o início e execução da prestação de serviços durante o período de livre resolução.
O disposto nos presentes Termos e Condições não prejudica os direitos imperativos reconhecidos ao consumidor pela legislação aplicável.
Os dados pessoais fornecidos no âmbito do pedido, marcação e realização da consulta serão tratados para efeitos de gestão da marcação, preparação e prestação do serviço jurídico e cumprimento das obrigações legais e profissionais aplicáveis.

As informações transmitidas no âmbito da consulta são tratadas com confidencialidade, sem prejuízo das regras legais e deontológicas aplicáveis ao exercício da advocacia.
A advogada titular do escritório e os demais advogados que intervenham no assunto encontram-se sujeitos ao dever de segredo profissional nos termos legalmente aplicáveis.
Os presentes Termos e Condições são regidos pela lei portuguesa.

TERMS AND CONDITIONS FOR LEGAL CONSULTATIONS
These Terms and Conditions govern the booking and provision of legal consultations by MAPV Advogados.
MAPV Advogados is the name used by the law office of Dr Maria Alexandra Celorico Moreira Pacheco Vieira, Lawyer, Portuguese Tax Identification Number (NIF) 186 645 180, with professional address at Avenida Infante D. Henrique, no. 43, Ground Floor, 9500-150 Ponta Delgada, email address alexpvieira-42a@adv.oa.pt, and telephone number +351 296 307 19.
The legal consultation constitutes an initial opportunity to assess a specific legal question or situation.
During the consultation, the main elements presented by the client will be analysed, the relevant legal issues will be clarified and, whenever possible, the potential options, procedures or steps to be taken will be identified.
The consultation may take place in person at the offices of MAPV Advogados in Ponta Delgada or remotely by videoconference.
The consultation has a maximum duration of 60 minutes and a fixed fee of €140.00, regardless of the actual duration of the meeting within that period.
The fee covers the consultation and the assessment of the matter presented, under the terms set out in these Terms and Conditions.
If the matter requires additional work, such work is not included in the consultation fee and will be subject to a separate agreement as to its scope and applicable fees.

The consultation is intended to address a specific legal matter. If the client wishes to discuss separate or unrelated matters, an additional consultation may be required.
Whenever documents relevant to the matter under consideration exist, they should, whenever possible, be provided before the consultation.
The review included in the consultation fee is limited to documentation that is essential and of a reasonable volume for the preparation and conduct of the meeting.
Where the documentation is particularly extensive or complex, or requires an in-depth legal analysis, MAPV Advogados may inform the client in advance that additional work will be required, subject to a separate quotation or fee agreement.
The client is responsible for ensuring that the documents and information provided are complete and accurate to the extent necessary for the assessment of the matter.
Unless expressly agreed otherwise, the consultation does not include:
Any additional services will be subject to a separate agreement regarding their scope and applicable fees.
Completion of the form available on the website constitutes only a booking request and does not automatically confirm the consultation.
Following receipt of the request, MAPV Advogados will review it and, where necessary, verify the absence of conflicts of interest and compliance with any other applicable professional obligations.
The booking will only be considered accepted following express confirmation by MAPV Advogados, specifying the date, time and format of the consultation.
MAPV Advogados may request additional information before confirming the consultation where such information is required to identify the matter or verify the existence of any professional impediment.
Payment for the consultation may be made by:
MAPV Advogados does not have an electronic payment terminal (Multibanco).
Following confirmation of the booking, the client will be provided with the necessary payment instructions.
Where advance payment is requested, the consultation will be deemed definitively reserved upon receipt or confirmation of the relevant payment, unless expressly stated otherwise.
If the client is unable to attend on the scheduled date, they should notify MAPV Advogados as far in advance as possible.
Rescheduling will be subject to the availability of the office.
MAPV Advogados may also propose that the consultation be rescheduled where professional, personal or force majeure circumstances prevent it from taking place on the date originally scheduled.
The client may cancel the consultation by notifying MAPV Advogados.
Where cancellation is notified less than 24 hours in advance, or where the client fails to attend without prior notice, MAPV Advogados reserves the right to consider the consultation fee payable, taking into account the professional time reserved for that purpose.
This rule is without prejudice to duly justified exceptional circumstances or to any rights to which the client may be legally entitled as a consumer.
If the client arrives late, the consultation will, in principle, end at the time originally scheduled so as not to affect subsequent appointments.
Whenever possible and subject to availability, an adjustment may be agreed.
Where the delay is attributable to MAPV Advogados, the client will be provided with the full consultation period contracted or another suitable time will be agreed.
The provision of the consultation does not oblige the client to retain MAPV Advogados for additional legal services, nor does it oblige MAPV Advogados to accept any subsequent engagement.
If further legal assistance is required following the consultation, the scope of the services to be provided and the applicable fees will be agreed separately.
Where the consultation is contracted at a distance by a natural person acting for purposes outside their trade, business, craft or profession, the statutory consumer protection regime applicable to distance contracts may apply.
In such cases, the consumer is generally entitled to a 14-day period from the date on which the contract is concluded within which to exercise the right of withdrawal, without having to provide any reason, pursuant to Decree-Law no. 24/2014 of 14 February.
If the consultation takes place before the expiry of the 14-day period, the statutory rules governing the commencement and performance of services during the withdrawal period will apply.
Nothing in these Terms and Conditions shall prejudice any mandatory rights granted to consumers under applicable law.
Personal data provided in connection with the request, booking and provision of the consultation will be processed for the purposes of managing the booking, preparing for and providing the legal service, and complying with applicable legal and professional obligations.

Information provided in connection with the consultation will be treated confidentially, without prejudice to the legal and professional rules applicable to the practice of law.
The lawyer who is the proprietor of the law office, as well as any other lawyers involved in the matter, are subject to the duty of professional secrecy in accordance with applicable law.
These Terms and Conditions are governed by Portuguese law.
